Defective Notice to Quit

LVT Number: 8987

Landlord bank sued to evict tenant. Bank bought tenant's building at a foreclosure sale and served tenant with a 10-day notice to quit. Tenant argued that the notice to quit was defective, and asked the court to dismiss the case. The trial court ruled for bank, and tenant appealed. The appeals court ruled for tenant. The 10-day notice was defective. It didn't advise tenant that she'd be evicted if she didn't move out in 10 days, didn't properly identify bank as the purchaser in the foreclosure, and didn't describe the apartment with enough specificity.
