Debris Not Located on Landlord's Property

DOS issued a violation notice to landlord after finding debris on the lot outside his building. Landlord claimed that the lot described wasn't part of his property. The ALJ ruled against landlord and fined him $50. Landlord appealed. The violation notice stated that the debris was found on a grassy area near a fence. Landlord showed that his lot was covered with gravel at the base of a wall running the width of the lot. There was no grassy area. ECB ruled for landlord and revoked the fine.
