Correction of Rent Administrator's Clerical Error Reduces Rent Overcharge

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant and ordered landlord to refund $9,860, including triple damages and interest and the deduction of a refund previously made to tenant. Landlord appealed and won, in part. Landlord pointed out that the DRA incorrectly found that tenant paid $1,366 per month when tenant actually paid $1,336 per month. The DHCR corrected the DRA's clerical error and reduced the total refund due tenant to $7,594.
