Corporation Owns Building

LVT Number: 16323

Landlord sued to evict rent-stabilized loft tenant for owner occupancy. Tenant claimed that landlord didn't qualify as a landlord permitted to recover on landlord occupancy grounds and asked the court to dismiss the case. The court ruled for tenant. Landlord held a proprietary lease to tenant's loft. But the building never completed the cooperative conversion process. So landlord never became an individual landlord of the apartment. Tenant's loft was still owned by the corporation that owned the building.
