Constructed Enclosure Included in Oil Tank MCI

Landlord applied for MCI rent hikes based on the installation of a new boiler and oil tank. The DRA ruled against landlord because landlord's application wasn't submitted within two years of completion of the work. Landlord appealed and won. Landlord showed that, after installing the oil tank, it constructed an enclosure. This was related to and done soon after installation of the oil tank. Landlord's application was submitted within two years of the entire project, so MCI increases were granted.
