Computer Printout of Payment Record OK as Evidence

LVT Number: 9374

Landlord sued tenant for unpaid rent and for use and occupancy. Landlord asked the court to consider a computer printout of tenant's payment record, but the court ruled that this wasn't valid evidence. Tenant won, and landlord appealed. The appeals court ordered a new trial because the lower court had based its decision on the mistaken ruling disallowing landlord's evidence. A computer printout can be acceptable to prove landlord's business records, as long as landlord explains how it got the information.
