Complaint Filed Before April 1, 1984

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Among other things, landlord argued that amendments made to the rent stabilization law by the Rent Regulation Reform Act of 1997 barred the DHCR from examining the rent history of tenant's apartment before 1980. The DHCR ruled against landlord. Tenant's complaint was filed before April 1, 1984. The RRRA 97 didn't amend that portion of the law pertaining to complaints filed before this date. The DHCR could review the full rent history in this case.
