Chairs, Table, and Plants on Roof

DOB issued a violation to landlord for occupancy of the roof that violated the building's C of O. The DOB inspector had found a table, six chairs, and 15 potted plants on the roof. Landlord claimed that DOB issued the wrong kind of violation and that it shouldn't have to amend its C of O to permit the inconsistent occupancy created by tenants. The ALJ ruled against landlord and fined him $800. Landlord appealed and lost. Landlord must either remove the cited items from the roof or take steps to legalize this occupancy on the roof.
