Cellar Arranged for Use as Apartment

DOB issued a violation notice to landlord for alterations that resulted in the creation of an illegal cellar apartment. The ALJ ruled for landlord and dismissed the violation, finding that the building wasn't occupied by more than the legally approved number of families. DOB appealed and won. Landlord had placed a stove and sink in the cellar, which already had a bathroom. This showed that the cellar was being ''arranged for use'' as an additional apartment, in violation of DOB regulations.
