Bathroom Drain Not Defective

Tenant complained of a reduction in services based on a defective bathtub drain. The DRA ruled against tenant based on an inspection that showed that the drain was being maintained. Tenant appealed, claiming that the condition still existed. The DHCR ruled against tenant. The bathtub drain wasn't backing up at the time of the DHCR's inspection. So the DRA properly dismissed tenant's complaint.
