Base Rent Frozen by Prior Rent Reduction Order

Tenant complained of a rent overcharge. The DRA ruled against tenant, finding that rent increases collected over the base date rent were legal. Tenant appealed, claiming that her base date rent should remain frozen due to a DHCR rent reduction order based on reduction in services that was in effect on that date. The DHCR ruled for tenant and directed landlord to refund $3,000.
