Apartment Never Subject to Rent Stabilization

Landlord sued to evict tenant after tenant's lease ended. Tenant claimed that he was rent stabilized and that landlord hadn't sent him a nonrenewal notice. The court ruled against tenant. Tenant and prior landlord signed a settlement agreement in a prior court case, by which tenant dropped a claim that he was rent controlled and prior landlord gave tenant a rent-stabilized lease. But the agreement wasn't made binding on future landlords. And the building only contained three apartments. So legally, tenant wasn't rent stabilized.
