Apartment Decontrolled upon 1971 Vacancy

In 1984, landlord filed a report of statutory decontrol with the DRA. Landlord claimed that prior tenant had lived in the apartment on June 30, 1971, but had later moved out. The current tenant moved into the apartment in March 1973. Landlord claimed she was rent-stabilized. Tenant claimed she was rent-controlled. The DRA ruled for landlord, and tenant appealed. Tenant claimed that she took over prior tenant's apartment in 1966, but continued to pay rent directly to prior tenant, who was her cousin, rather than directly to landlord until 1971. The DHCR ruled against tenant.
