Air Conditioner Sleeve Improperly Installed

DOB issued a violation notice to landlord for performing work without a permit. Specifically, DOB's inspector noted that an air conditioner sleeve and unit were installed improperly, and two iron security doors, one in the front and the other at the rear of a fire corridor, had improper swings. Also basement-level windows were sealed. Landlord claimed that these conditions existed when it bought the building, so the violation should be dismissed. The ALJ ruled against landlord and fined it $1,600. Landlord appealed and won.

Also basement-level windows were sealed. Landlord claimed that these conditions existed when it bought the building, so the violation should be dismissed. The ALJ ruled against landlord and fined it $1,600. Landlord appealed and won. Landlord had submitted a copy of an affidavit from the prior building super. These were routinely accepted by ECB and, although it was a copy, the super's statement contained specific details that showed that the items in question were in place when landlord bought the building.
