Agent Can't Sign Termination Notice

Landlord sued to evict rent-controlled tenant. Tenant claimed that landlord's termination notice was defective because it was signed by an agent not authorized to sign the notice on landlord's behalf. The court ruled for tenant and dismissed the case. New York City rent control regulations require that landlord sign a termination notice delivered to a statutory rent-controlled tenant. Only a notice delivered to a month-to-month, rent-controlled tenant can be signed by either landlord or landlord's agent under RPL Section 232-a.
