Additional MCI Rent Hike Permitted Due to Change Orders

Landlord applied for MCI rent hikes based on a roof/cornice installation and related work. The DRA ruled for landlord in part but disallowed any increase for additional work performed under five change orders submitted by landlord. The DRA found that the change orders weren't properly executed prior to the commencement of the work involved. Landlord appealed and won. The DRA erred by not giving landlord a chance to submit properly executed change orders. Landlord submitted these with its PAR and therefore was entitled to an additional rent increase for the additional work performed in connection with the approved MCI.
