Accepting 12 Months' Rent in Advance

Landlord asked the DHCR if it was permissible under rent stabilization to accept 12 months' rent in advance from new tenant. In an opinion letter, the DHCR stated that this wouldn't constitute a rent overcharge if tenant voluntarily offered the full year's rent in advance and if the amount collected wasn't greater than 12 months' legal rent.
