1958 Records Show Tenant Is Rent Controlled, Not Stabilized

Tenant complained of a reduction in garage services. The DRA ruled for tenant and reduced her rent. Tenant appealed because the DRA's order stated that tenant was rent stabilized. Tenant claimed that she was rent controlled. The DHCR ruled for tenant. Although tenant was listed as rent stabilized in the DHCR's 2002 annual rent registration, other agency records showed that tenant was listed in a 1958 order fixing the maximum rent for her apartment. Tenant's rent reduction was modified to a dollar amount rather than the guidelines increase used for rent-stabilized tenants.
