Tenant Challenges Room Count

Tenant complained of a rent overcharge. She claimed that she was charged an MCI rent hike based on a four-room apartment. Tenant claimed that her apartment had only three rooms. The DRA ruled against tenant. Tenant appealed and lost. Tenant had appealed the DRA's MCI rent hike ruling, and the DHCR had denied tenant's PAR. Because the DHCR had already issued a final ruling that tenant's apartment contained four rooms, tenant couldn't claim, in a new case, an overcharge based on the number of rooms.
