Rider Didn't Specify Pending Application

Tenant complained of a rent overcharge. The DRA ruled for tenant, finding that landlord couldn't collect from tenant an MCI rent increase granted on July 22, 1997, during the term of tenant's lease of May 1, 1996, through April 30, 1998. Landlord appealed, claiming that he had sent tenant a renewal lease with an MCI rider. The DHCR ruled against landlord. Landlord's lease rider didn't specify what improvements were being made, what DHCR docket number was assigned, or how much the increase might be.
