Rent Frozen Until Landlord Files Missing Annual Rent Registrations

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant and directed landlord to refund $17,560, including triple damages. Landlord appealed and lost. The base date rent in September 2012 was $1,900 per month, which was the amount charged to prior tenant at that time. The lease was renewed twice after that, but landlord didn't file annual rent registrations for the years 2013 through 2017. So, under Rent Stabilization Code Section 2528.4(a), landlord was barred from collecting any rent increase until the outstanding registrations were filed.
