Loft Board Previously Ruled Apartment Wasn't Rent Regulated

Landlord sued to evict month-to-month tenant and asked the court to rule in its favor without a trial. The court ruled for landlord. Tenant appealed and lost. Tenant couldn't claim that the apartment was rent regulated based on a 2005 Loft Board order. That order held that the apartment wasn’t subject to rent regulation. Tenant’s Article 78 appeal of the Loft Board’s decision was denied by a court, and tenant didn’t appeal that any further.
