Late Renewal Lease Must Have Later Start Date

Rent-stabilized tenant complained that landlord didn't offer her a renewal lease. The DRA ruled against tenant, finding that landlord had sent her a late renewal offer. Tenant appealed. She said that she didn't get the signed renewal until July 2004 but that landlord started charging her the renewal increase in May 2004. The DHCR ruled for tenant. When landlord offers tenant a late renewal lease, the renewal can't begin until 90 days after tenant gets a signed copy of the lease. The correct start date of tenant's lease renewal was Oct. 1, 2004.
