Landlord's Room Count Incorrect

Landlord applied for a 2006 fuel cost adjustment to the rent-controlled rents in the building. The DRA ruled for landlord, but found that the total number of rooms, for the purpose of calculating the rent increase, was 29, not 27 as claimed by landlord. Landlord appealed, claiming that his count was correct. The DHCR ruled against landlord. The DRA's ruling was based on two inspections conducted at the building in 2005.
