Landlord Waived Air Conditioner Surcharge

Rent-stabilized tenant complained of a rent overcharge after landlord started billing her a rent surcharge for her air conditioner. The DRA ruled for tenant. Landlord appealed and lost. Tenant submitted proof that she installed the air conditioner in 2000. Landlord didn't start billing the surcharge until 10 years later. So landlord waived the right to collect any surcharge for the air conditioner.
