Landlord Gets MBR Increase

Landlord applied for 2004-2005 Maximum Base Rent (MBR) increases for rent-controlled tenants. The DRA ruled for landlord, finding that there were no new HPD violations at the building since 2001. Tenants filed objections to the MBR increases, claiming that the building was infested with vermin, that the building was dirty, that water leaked into all the apartments, and that windows didn't operate properly. The DRA ruled against tenants. Tenants appealed and lost. Landlord certified that at least 80 percent of the nonrent-impairing violations on record with the HPD as of Jan.
