Landlord Didn't Submit Complete Rental History

The DHCR's records showed that tenant wasn't the first stabilized tenant; the apartment had been vacancy-decontrolled some time before tenant moved in. Landlord still didn't produce a complete rent history. However, landlord wasn't responsible for any of the refund due. Tenant's complaint was filed before April 1, 1984; the overcharges occurred before that date; and landlord didn't collect any of the overcharges.
