Landlord Didn't Get MBR Fee Payment Notice

Landlord applied for MBR rent increases for the 1986-87 cycle. The DRA ruled for landlord and stated that landlord would receive a statement of filing fees due. The DRA later revoked landlord's MBR increases based on landlord's failure to pay the MBR increase filing fees. The fees were $20 per apartment, and the building contained over 100 apartments. Landlord claimed that it never got notice of the fees due. The DRA ruled against landlord. Landlord appealed and won. The DHCR's records contained no proof that the fee statement notice was sent to landlord for the MBR cycle in question.
