Landlord Can't Evict Super After Employment Ended

Landlord sued to evict the building's superintendent after the super's employment ended. Landlord had agreed with super in 1986 that if he took on the job, he would be allowed to remain in the apartment at a rent to be agreed upon if the job ended. The court ruled against landlord. Landlord's agreement to rent the apartment to super at a rent to be agreed upon when or if his employment ended should be enforced consistent with the Rent Stabilization Code, which contains a procedure for setting the rent for apartments occupied by landlord's employees.
