Landlords, husband and wife, sued to evict rent-stabilized tenant for owner occupancy. They lived with their children in the apartment next door to tenant's apartment. The court ruled for landlords after a trial. Tenant appealed and lost. Landlords showed that they genuinely intended to occupy tenant's apartment as part of an overall, documented plan to expand their own apartment to add a library and study area for their children.
