Inadequate Freezer Temperature

Tenant complained of a reduction in services based on inadequate freezer temperature. The DRA ruled for tenant. Landlord appealed and lost. An inspection showed that tenant's freezer temperature was 15 degrees Fahrenheit. DHCR policy requires freezer temperature to be set and maintained between zero degrees Fahrenheit and five degrees Fahrenheit. This standard is based on the recommendation of the Association of Home Appliance Manufacturers. Landlord showed no proof that this requirement was contrary to law or that the 15 degree temperature was proper.
