Gas, Electricity Not Required Services

Tenant complained of a reduction in services because landlord no longer paid for gas and electricity in her apartment. The DRA ruled against tenant. Tenant appealed and lost. When tenant first moved into the apartment, she didn't have a lease, and landlord paid the gas, electricity, cable, and telephone bills. Tenant had raised these claims in a prior rent overcharge complaint. In that case, the DHCR had decided that those services wouldn't be included in the legal regulated rent for the apartment. Tenant can't raise these claims again in a reduction in services complaint.
