Dirty Courtyard

Tenants complained of a reduction in building-wide services. The DRA ruled for tenants based on a finding of a dirty courtyard, and reduced their rents. Landlord appealed, pointing out that other areas inside and outside the building were found to be in clean condition by DHCR's inspector and that tenants and wind caused debris to accumulate in east courtyard. The DHCR ruled against landlord. Landlord was responsible for maintaining all areas of the building, including the courtyard, in a clean condition.
