The tenant died while the proceeding was pending, and the son then claimed succession rights. The court dismissed that proceeding as a result of tenant's death, noting that the dismissal was without prejudice to landlord's rights to commence a licensee holdover against the son. Ten days later, landlord locked the son out of the apartment.
