Workers Didn't Have Protective Clothing

The DEP issued a violation to landlord and its asbestos abatement contractor for not following city asbestos regulations, including failure not providing protective clothing to all asbestos workers. Landlord and the contractor challenged the violation. The ALJ herself visited the premises and observed workers engaged in encapsulation activities without wearing gloves. Also no worker decontamination enclosure system had been built. Penalties of $8,000 were imposed. Both landlord and contractor appealed.

The ECB found that the ALJ's findings as to the credibility of testimony and the weight given to various evidence were proper. The appeals were dismissed.
