Work Related to New Roof Qualifies

Landlord applied for MCI rent increases based on a number of improvements. The DRA ruled for landlord in part, giving an increase for a new roof but disallowing any increase for the cost of parapet and chimney work. Landlord appealed and won. The DRA had excluded these costs because they weren't included in the contract for the roof. But landlord had submitted two work orders supplementing the master contract, adding the two items in question. DHCR policy allows an MCI increase for parapet work done in conjunction with an MCI for a new roof.

DHCR policy allows an MCI increase for parapet work done in conjunction with an MCI for a new roof. The brickwork to one of the chimneys done to protect the new roof also should qualify, being similar to bulkhead work done in conjunction with a new roof for which the DHCR permits MCI increases.
