Work Qualified as Ordinary Maintenance

Tenant complained of a rent overcharge. The DRA ruled for tenant and reduced her rent. Among other things, the DRA disallowed the cost of certain work done to the apartment that landlord claimed amounted to 1/40th improvements. Landlord appealed. The DHCR ruled against landlord. Removing wall paper, plastering, painting, redecorating, and scraping and coating floors with polyurethane were all ordinary maintenance and repair work. No rent increase was warranted.
