Work Found Unrelated to Entrance Door and Hallway Flooring Installations

Landlord applied for MCI rent hikes. The DRA ruled for landlord in part and approved an increase for the installation of basement, vestibule, and entry doors as well as work relating to the hallway flooring of ceramic tiles and stones. The DRA denied any increase for the installation of a new entrance step, new canopy, and new front railing; cleaning and repairing cracks at the main entrance; arch woodwork, acoustic ceiling installations, and related patch work; and drywall, carpentry, and painting of hallway walls.

Landlord appealed and lost.  None of the disallowed work constituted MCIs, and landlord didn’t show that any of it was necessary work performed in connection with and directly related to the MCI work. The disallowed work was all ordinary repair and maintenance work.
