Who Gets Refund for Section 8 Tenant?

Landlord asked the DHCR who should get the refund when the DHCR finds that a Section 8 tenant has been overcharged. The Section 8 agency that paid a part of the rent wasn't part of the proceeding. The DHCR advised landlord to refund the overcharge to the Section 8 agency, even though it hadn't been a party to the original rent overcharge complaint.
