Waterproofing Back Walls and Airshafts

Landlord applied for MCI rent hikes based on waterproofing a building's back walls and airshaft. The DRA ruled against landlord, finding that landlord hadn't filed the application within two years of completing the installation. Landlord appealed and showed that the application was filed on time. But the DHCR still ruled against landlord. Only waterproofing was done on the back wall and the airshafts. Comprehensive pointing and waterproofing as needed on exposed sides of a building are needed to qualify as an MCI.
