Water Tank Qualifies

Landlord applied for MCI rent increases based on the installation of a water tank. The DRA granted landlord's application, and tenants appealed. They claimed that the water tank wasn't a building-wide improvement because it benefitted tenants on the upper floors only. The DHCR denied tenants' PAR.

They claimed that the water tank wasn't a building-wide improvement because it benefitted tenants on the upper floors only. The DHCR denied tenants' PAR. Although a water tank assists water flow and distribution to the upper floors, it also distributes water to all apartments as part of the building's single, integrated water supply system. This benefits all tenants in the building.
