Water Main Installation Without Related Repiping Doesn't Qualify as MCI

Landlord applied for MCI rent hikes based on installation of a new water main. The DRA ruled against landlord, who appealed and lost. It is long-standing DHCR policy that a water main doesn’t qualify as an MCI unless it is installed in connection with repiping that includes the installation of new hot and cold water risers, returns and branches to fixtures in every apartment, or new overhead mains with all necessary valves.
