Water and Waste Lines Installed Without Permit

DOB issued two violation notices to landlord for performing work without a permit. DOB's inspector said he observed water and waste lines installed for a residential sink in the building's cellar without a permit. Landlord didn't claim that this condition was pre-existing when she bought the building. The ALJ fined landlord $1,250. Landlord appealed and lost. For the first time, on appeal, landlord claimed that the basement had a bathroom and water lines when the house was built.

But landlord didn't raise this before the ALJ, and this wouldn't be considered for the first time on appeal.
