Waste Water Line Installation Doesn't Qualify

Apartments in landlord's building contained bathtubs in the kitchens and very small bathrooms. Landlord proposed to alter each apartment to move bathtubs into larger bathrooms and to construct boxed waste water lines running from floor to ceiling. Landlord asked whether the work would qualify as an MCI. In an opinion letter, the DHCR said no. The waste water line installation, on its own, didn't constitute a major improvement. Repiping, which would qualify, was defined to mean installation of new hot and/or cold water risers, returns, and branches to fixtures in each apartment.
