Warrant Vacated Against Tenant Getting Public Assistance

Landlord sued to evict tenant for nonpayment of rent. The court ruled for landlord and found that tenant owed $2,500 in back rent. Tenant was evicted before she was able to pay the back rent owed. Tenant then asked the court to be restored to possession. She claimed that she had applied for public assistance and that, despite her efforts, she didn't get her payments on time. The court ruled for tenant and restored her to possession. Tenant was rent stabilized and had lived in the apartment for 15 years.

She had applied to the DSS and to the Church Avenue Merchants Block Association (CAMBA) for assistance. CAMBA was working on tenant's behalf to get Jiggets relief for tenant. But, because of a series of errors by both the DSS and CAMBA, over which tenant had no control, available checks for back rent weren't delivered for payment before the court-ordered due date.
