Violations Against Landlord Dismissed

HPD sued landlord for falsely certifying corrections of lead paint violations. The court fined landlord $10,000 for each of three false certifications of correction of lead paint violations under Local Law 38. Landlord appealed and won. The state's highest court had struck down Local Law 38 earlier in 2003. So the civil penalty provisions that landlord's fines were based on no longer existed. The fines were revoked, and the case was dismissed.
