Violation Notice Not Mailed to Second Address

DOS issued a violation notice to landlord. Landlord claimed improper service. The ALJ ruled against landlord since copies of the notice were both left at the building and mailed to the building. Landlord was fined $50. Landlord appealed and won. A second mailing was required to be sent to the address used by landlord in Finance Department, HPD, or DOS records. Since Finance Department records showed that tax bills were mailed to landlord at an address other than the building, another copy of the violation notice should have been mailed there. The violation was dismissed.
