Violation Issued During Stipulation Period

The DOB issued a violation notice to landlord for not maintaining an elevator. Landlord argued that the violation was issued during a period covered by a 75-day stipulation that landlord had entered into with the DOB. The ALJ dismissed the violation, and the DOB appealed. The DOB argued that the violation was issued in August 1991 and that the stipulation wasn't signed until September of that year. The ECB ruled for landlord. The stipulation was specifically made retroactive to July 16, so it covered the date the second violation was issued.
