Violation Issued on Collection Day

DOS issued a violation notice to landlord for not storing trash receptacles because landlord left three bags of garbage at curbside on a noncollection day. Landlord claimed that the date in question was a garbage collection day. The ALJ ruled against landlord and fined him $50. Landlord appealed. Landlord submitted a DOS memo stating that landlord's block had a different collection schedule from the rest of that district. ECB ruled for landlord and revoked the fine. Landlord had properly placed the trash at curbside for collection.
