Very Low Rent Not "Unique and Peculiar Circumstance"

Landlord asked the DRA for an increase to rent-controlled tenant's rent based on unique and peculiar circumstances. Landlord claimed that tenant's rent of $104 per month was too low when compared to other apartments in the surrounding Soho area. The DRA ruled against landlord. Landlord appealed and lost. A very low maximum collectible rent (MCR) isn't, by itself, a reason to grant landlord's rent increase request. Landlord owned the building since the 1970s and had gotten rent-controlled increases over the years through MBR increase filings.
